Press Release: i3Archive, Inc. and National Digital Medical Archive, Inc. Clarify Pending Patent Matter


Berwyn, Pennsylvania. i3Archive, Inc. and National Digital Medical Archive, Inc. (NDMA) ["the Company"] today announced that on September 25, 2006, the Company initiated an action against InSiteOne, Inc. in the United States District Court for the Eastern District of Pennsylvania seeking a Declaratory Judgment that claims of InSiteOne's U.S. Patent No. 6,574,742 are invalid and not infringed. On October 13, 2006, Defendant InSiteOne, filed its response to the Company's Complaint including an Answer, Affirmative Defenses and Counterclaim.


Derek Danois, the Company's President, responded, "There is a history between the companies. In fact, in March of 2006, our attorneys sent a cease and desist letter to InSiteOne regarding reported inappropriate business tactics on the part of InSiteOne. We filed this action after repeated attempts by the Defendant to intimidate our customers and threaten our business. We have reviewed the patent in question and are confident that the Defendant's counterclaim against our Company is without merit. The Defendant has misrepresented this matter in their October 17, 2006 press release in what we believe is a continued effort to malign our success. It is the intention of our Company to pursue its case of invalidity and non-infringement aggressively and to pursue all legal remedies available under civil law for all pending and future claims against the defendant. We will continue to partner with healthcare institutions worldwide to provide them with a state-of-the-art data management platform and world class service."

Formed in 2003, the Company acquired the rights to core technology that had been in development since the mid 1990s as part of a National Institutes of Health funded research project.
